Duke's Screwed Up Policy May Grant Giuliani The Win

Remember that whole Giuliani-Duke-golf-team-lawsuit-scandal thingy from the summer?
 

Well, apparently it’s not going away.
 

He’s still suing, and scarily enough, he may win.
 

A column in The Chronicle explains:

Andrew Giuliani's lawsuit in response to his "unfair" dismissal from the Duke men's golf team reeks of absurdity. Even from the filing's played-down summary of the conduct that led to his dismissal, it is clear that he was a cancer to the team - one who believed that his behavior would go unpunished.

Didn’t you notice his last name? Yeah, it’s Giuliani! As in the son of that famous politician guy. How could he get in trouble?
 

But, alas, the Duke Athletic Department is helping him make his case.

As hard as it is to believe, Duke's codified athletic policy only provides for removal of a student's athletic eligibility because of a short list of transgressions including felony charges, NCAA violations, academic cheating, drugs or alcohol. Page 11 of the Student-Athlete Handbook contains an extremely vague one-line reference to team rules, but no language refers to the extent or force of those rules.

Oops!
 

So now what?
 

Short of planting some drugs on the kid, Duke is screwed.

It is important to note the difference between "athletic eligibility" and the privilege of being on a team. Nothing has been done with regard to Giuliani's athletic eligibility - most college students will be eligible. However, that has nothing to do with a coach's decision as to whether or not he will play for the team. Talent and behavior can be used to determine a position on the team without having any impact on eligibility. Posted 09/13/2008 11:59 AMReply
