When Does a Hug Become Sexual Assault?

When Does a Hug Become Sexual Assault?
In April, Franklin Martin, a reserve offensive lineman on the football team, was indicted for rape charges. Then the charges were changed to assault and battery, and Franklin entered an Alford plea, which, instead of “guilty” or “not guilty,” means that there is enough evidence for conviction. He was, well, uh, convicted on Tuesday, and given a $2,500 fine, $2,000 of which was suspended as long as Franklin stays in good relations with the court and stays away from the victim.

Now, Franklin lived in my dorm freshman year, and always was a very friendly guy. A little too friendly, perhaps, in a hilarious “my huge football body will easily crush yours in a seductive embrace that will last way too awkwardly long” sort of way.

Anyway! I never considered any of that – affection? – as assault. Did this girl take it too seriously? Did he take the joke too far? Will Franklin ever get to play football again? Does the Facebook group “I’ve been molested by Franklin” (or something like that, I think I used to be a member) still exist? Is this now an inappropriate inside joke? Can I continue to write a whole paragraph in all questions?

Sports and sexual assault. They always seem to go together (Duke, Kobe). Posted 08/02/2007 12:54 PMReply

FYI- 'This girl' asked her yr and a half friend (sober Franklin) for a ride home because she was blacked-out intoxicated. Next thing she remembers is the almost 400 pound man raping her.

I have some qustions for you 'BabySpice'.... if you had a 400 pound man forcing himself on you while you were a blacked-out-ragdoll, would you take that seriously? or consider it a 'hug'?

Also- his entire facebook account was removed, (along with the incriminating 'I've been molested by Franklin' facebook group)right after he was arrested for felony rape. Interesting coincidence I think.

Also- I would love to see what other JMU-ers thought about having a football player representing JMU who preys on women by forcing himself on them when they cannot fight back, or even say 'NO' because they are helplessly incapacitated.(btw- he was engaged at the time of the incident to another woman)

As a JMU-er myself, it makes me sick to know that our university continues to provide an education (free of charge b/c he is on a football scholorship) to sexual predators.

"all together one" ~ironic isn't it....

Well, anonymous, you're right! You crazy commenters sometimes are. I didn't do amazing research on this post - those serious articles with all the gory details have all been written. I'm glad you added some facts in here for me. If there's anything I have learned about JMU and (on or off) campus safety, it's that it is taken seriously - especially something like sexual assault. I just was putting my personal - perhaps inappropriately light - spin on an otherwise horrifying and disappointing story.

And I will continue with my current dedication of revealing football players (who you're right - parade around representing our school all the time) doing stupid/annoying/whiny/lame/horrifying/inappropriate things. Because they should know better. And act better.

I agree. As a close friend of the supposed rapist, I can verify that he would have never done such a thing. Also as a JMU hottie of the week, I am probably far better looking than all of you, I have slept in a bed with Franklin and he has never touched me. I think your parents would be upset if they knew you were spending their hard-earned tuition money to "reveal" football players. I'm going to further stipulate that you most likely have had a train or two run on you. It's ok... let it go. Maybe you should take some time off, get a life, and let your absurdly loose pussy tighten back up. Posted 01/28/2008 12:35 PMReply

@ BabySpice: BabySpice it was said that she was on top in a very conscious and well balanced act of vigorousness and he stopped her, so I think he'd like you to get some ProActiv and lose that freshman 50 and try to find someone who will love you for your fat, disgusting, cratered ass. Yea football players are asses but everyone wants to be one, don't get mad cause they won't even look at you. Posted 01/28/2008 1:01 PMReply

I must give you a hand for your usage of the internet and the First Amendment. However, with this new form of blog judgment, criticism, and character deformation (legal) I will propose this. I hope you have never slept or been with a football player. For every new article or blog that posts about the football team, I will join this blog and add ten ppl who have something to keep secret that only one of the members of the team would know. Be warned, you will be endangering your friends, family, classmates and possible self. I am very articulate, resourceful, and you could not pick me out of a crowd. I'll be watching and taking notes and pics if necessary. P.S.
I wish a mother%%^&$%& would write something about me. If you woman enough to write it, be woman enough to put your face on it, because I will. Its hard enough you think that we are incompetent. Kick rocks.

Just so you know, I do not blog for OTR any more. I suggest you email the managing editor, Beth Milton [beth.milton@theu.com], to bring up legal things like defamation.

You can also read the Daily News Record article [http://www.rocktownweekly.com/news_details.php?AID=11452&CHID=2] to find the same factual information I found about this post. I apologize for offending; in fact, for this reason I do not blog for OTR anymore.

Thank you for your opinions and your concern.@ Anonymous:
