 You might remember that back in May eight students were arrested and charged with open lewdness after participating in the annual Mifflin Streak. Well, the pre-trial hearings are done and the only female streaker is fighting the charges by saying she did not "affront or alarm" anyone during her naked run. Actually I'm pretty alarmed that I didn't see her naked affront or even her a-back.

 

According to Pennsylvania law, "A person commits a misdemeanor of the third degree if he does any lewd act which he knows is likely to be observed by others who would be affronted or alarmed." So Elizabeth Burke, the female streaker, and her lawyer are arguing that charges should be dropped because no one who witnessed the streak could have been affronted or alarmed since they showed up for the sole purpose of viewing naked people running.

 

“Just because a person doesn’t approve of the streak, that doesn’t make it a criminal act,” said attorney Stacy Parks Miller, who represents Burke. “Have we lost our senses of humor?”

 

Burke is the only one of the eight streakers who is fighting the charges. So far the other seven have chosen to either accept Accelerated Rehabilitative Disposition or given summary guilty pleas. Here's the problem for Burke, and why if I was her I would just take ARD: as far as I can tell, open lewdness is a sex crime (if I'm wrong here, someone let me know). That means anyone convicted would have to register as a sex offender. Just for about 30 seconds of running naked at midnight while in college.

 

The judge in the case found enough evidence to go to trial but Parks Miller is hoping to have the charges dropped in the Court of Common Pleas because she said there are no witnesses who say they were offended. Well, I hope Burke doesn't have any enemies who were there that night.

 

As a side note, where the hell are the pictures of this? I know some of you sickos were there with cameras in hand. And if you weren't, shame on you. I would have been clicking away. I would have been taking pictures too. OOOOOOWA!

Open lewdness is not a sex crime whatsoever and is only a misdemanor of the third degree. really insignificant. Usually reserved for persons who pee in public or other such nuisance acts....Not a sex crime at all...why should cops/court get to rack in all this money and so forth if its not reallyc riminal?
