Former Hilton manager Deborah Smith has recently filed a lawsuit against the hotel for "undirected sexual harassment" after walking in on upper management having an orgy. After entering a banquet room, Smith "discovered an orgy" wherein "various... inebriated... Hilton executives" were "on top of a table engaging in sexual activity". The lawsuit concerns Smith's eventual firing, which she claims was due to the "campaign of harassment and retaliation [that] ensued" after she brought complaints of the orgy to her human resources department.
The nature of the case is an interesting one. Is this sexual harassment? The Minnesota Human Rights Act defines sexual harassment as "unwelcome sexual advances, requests for sexual favors, sexually motivated physical contact or other verbal or physical conduct or communication of a sexual nature," but does this stumbling upon group sex fall under this definition? That's for the courts to decide, and this case may set a precedent for any future hot office on-the-table group **** sessions in your workplace.
