The family of Phanta "Jack" Phoummarath, a University of Texas at Austin student who died after a fraternity binge-drinking party, decided to settle their lawsuit against the fraternity and Austin chapters for $4.2 million.
Phoummarath, 18, was a freshman at UT when he pledged for Lambda Phi Epsilon and attended their binge-drinking party, where he died in a garage apartment from alcohol poisoning in 2005.
The family claims the settlement money will go towards an educational video and a scholarship in honor of Phoummarath. According to the autopsy, his blood-alcohol level was 0.41, more than five times the legal limit for driving in Texas.
The three other frat members brought up on trial pled no contest to charges of hazing. The Lambda Phi Epsilon chapter in Austin also agreed to surrender its charter until 2011 and pay a $5,000 fine.
