Man Killed In Shooting Near Campus
The Shooting Took Place Outside Of Top Dog (pictured above).

There was a shooting in the parking lot near Top Dog on Durant and Bowditch (pictured above) this afternoon at approximately 3:45pm. Various sources including the Daily Cal (which is nearly impossible to load due to high traffic) are saying a man was shot six times by an unidentified assailant. CBS is reporting that 911 phone calls were made at 3:49pm to report a man with a gun and at 3:51pm to report a male victim and the apparent shooter fleeing in a silver car. Students walking home from campus saw several police cars and the entire block of Durant from below Bowditch to College closed off to pedestrians and cars.

According to Berkeley PD, the victim is not affiliated with the university and the university is not in immediate danger, as this was not an active shooter situation. They are also reporting one victim being treated for injuries.

UPDATE: The victim is said to have been in his early 20's and African-American. Police and fire personnel administered CPR and first aid for about 30 minutes before stopping. The man supposedly seen fleeing in a silver Cadillac was injured in the scuffle and was pursued to Highland General Hospital in Oakland and is now being detained and questioned by police. It is not known for certain whether he was involved. Witnesses say they heard gunshots after several minutes of verbal arguing between several men.

ANOTHER UPDATE: Previous reports that the victim was in his early 20's were incorrect; in fact, the victim was Berkeley resident Maceo Smith, 33, father of three young children. Smith was pronounced dead at the scene after sustaining several gunshot wounds. The second victim, unidentified at this time, who drove to Highland General Hospital after the incident, sustained non-life-threatening injuries and is being treated. This is the fifth homicide in Berkeley this year, the second in the last two weeks.

ANOTHER ANOTHER UPDATE: Nathaniel Freeman, 19, has been charged with murder and assault with a firearm. The second victim has been identified as Marcus Mosley, Smith's former brother-in-law. Freeman apparently believed Mosley had disrespected him. Freeman turned himself into police on Wednesday and is being held without bail.
